This document sets out the Client Terms of Service and Conditions that apply to a subscription with Secure My Treasures P/L, http://www.securemytreasures.com.au
The following terms also apply to a subscription and are deemed to be part of this “Client Terms of Service and Conditions”:
- Cyber Security and Privacy Policy at http://www.securemytreasures.com.au
- The terms of use for the website or any mobile apps covered by the subscription.
Governing Law
Secure My Treasures P/L controls and operates this website, http://www.securemytreasures.com.au, from its offices within Australia. These Client Terms of Service and Conditions are governed by the laws of the State of Victoria.
A Client who has a subscription with Secure My Treasures P/L agrees to submit to the non-exclusive jurisdiction of the courts of Victoria, Australia. If you choose to access this site from another location, you are responsible for compliance with applicable local laws.
Subscription
A subscription with Secure My Treasures P/L is for 12 months.
A subscription begins on the day and time that you your subscription fee is received into the bank account of Secure My Treasures P/L. A subscription ends at on the same date the following year from when the subscription commenced. Unless, Secure My Treasures is advised otherwise, all subscriptions will be automatically renewed.
A subscription may be cancelled at any time. The Client holding a cancelled subscription must notify all of the Trustees of the Client’s Chests of the decision to cancel the subscription. The Trustees will also receive an email from Secure My Treasures advising that the subscription has been cancelled and that a Trustee will no longer be able to access Chests for the Client with the cancelled subscription.
You must also remove all information stored in Chests on Secure My Treasures P/L before the cancellation can take effect. If you do not remove your documents, they will be destroyed by Secure My Treasures P/L after 7 years. During this time you can still reactivate your subscription. However, you will not be able to retrieve the documents from your Chests unless you have reactivated your subscription.
A Trustee cannot cancel a Client’s subscription to Secure My Treasures P/L or remove documents from a Client’s Chest, even if they are also a client.
Subscription Not Transferable
A subscription is not transferable to another Client for any reason.
Care of Your Log In Details
The Client is responsible for ensuring the confidentiality of the Client’s username and password/passphrase. Secure My Treasures P/L is indemnified from any loss incurred by the Client if that loss is as a result of the Client not protecting the confidentiality of the Client’s username and password/passphrase.
If you share your login details with a third party, your subscription may be terminated without refund.
A Client must ensure that their user name and password/passphrase for the Secure My Treasures P/L website is secured, kept in a safe place and protected from unauthorised access.
ID Verification
Clients and Trustees must participate in ID verification every time they log into Secure My Treasures. This is to protect you and prevent fraud.
A Subscription
A subscription is charged and begins on the day and date that you subscription fee is received into the bank account of Secure My Treasures P/L. A subscription ends at on the same date the following year from when the subscription commenced.
You have 72 hours from the time your account is first created to pay your subscription fee, whether or not any Chests are built. Your account will be cancelled if the subscription fee is not paid within 72 hours. This means that any Chests you have created will be deleted.
Secure My Treasures P/L has the right to increase the subscription fee and renewal fee. Any changes to the subscription fee and renewal fee apply at the anniversary of the renewal of a subscription.
Acceptable Use
A Client must not:
- Use a subscription to Secure My Treasures P/L for any commercial purpose including on selling the subscription to a third party.
- Attempt to, encourage, or assist any other person to circumvent or modify any security technology or software that is part of the website.
- Copy, reproduce, adapt translate, translate, publish, create derivative works from, vary, merge or modify any Secure My Treasures P/L product in anyway including reverse engineering, disassembling and decompiling.
- Directly or indirectly introduce or permit the introduction by any third person any virus or worm, trojan or other malicious code into the website or in any other manner whatsoever, corrupt, degrade and disrupt the operation of the website.
- Allow any third party to do anything inconsistent with these Terms of Service and Conditions.
Use the website for any unlawful purpose or in any unlawful way.
Third Party Sites
This site may contain information from, or hyperlinks to, internet websites operated by third parties. Such information or websites are not under the control of Secure My Treasures P/L.
Secure My Treasures P/L is not responsible for the contents of any such information or the information contained on those websites. Secure My Treasures P/L provides such information and hyperlinks to you as a convenience only, and the inclusion of any link does not imply any endorsement of the linked website by Secure My Treasures P/L.
Ownership, copyright and trade marks
Secure My Treasures P/L owns this website, http://www.securemytreasures.com.au, and unless otherwise indicated, owns or is licensed to use all content and other material appearing on the website. The material on this website is protected by copyright under the laws of Australia and may not be used without written permission by Secure My Treasures P/L.
No trade mark, that is displayed on this website, may be used in any way without the prior written permission of Secure My Treasures P/L or of the relevant trade mark owner. You are not authorised, without the prior written permission of Secure My Treasures P/L and any other owner of rights in content that you access via this website, to reproduce, frame, download, store (in any medium), communicate, show or play in public, adapt, change, or create a derivative work from that content.
Revisions
Secure My Treasure P/L may revise or amend these Client Terms of Service and Conditions at any time at the absolute discretion of Secure My Treasure P/L by posting revised terms. Any revisions will be effective immediately. By continuing to use this site after any revision becomes effective, you agree to be bound by the revised Terms of Service and Conditions.
Acceptance
By using or accessing this website, you acknowledge that you have read, understood, and agree to be bound by these Client Terms of Service and Conditions.
If you do not agree to the Terms of Service and Conditions, please do not use this website. By using this website you are bound by these Terms of Service and Conditions which form a legally binding contract between you and Secure My Treasures P/L.
You agree that, in the event that any part of these Terms of Service and Conditions is found to be unenforceable, the remainder of these Terms of Service and Conditions remain in full force and effect.
